In 2026, many compliance officers are hearing the same line in more and more executive leadership team (ELT) meetings: “We want AI implemented this year.” The phrase sounds reassuring, as if time itself will do the work. It will not.
If you are at the table now, you have a narrow window to shape how AI enters your company: as a governed capability aligned to business objectives, or as a collection of tools that quietly create bias exposure, privacy incidents, and intellectual property headaches. For the compliance professional, my suggestion is to treat AI like any other enterprise change that can create legal, operational, and reputational risk. In other words, build the guardrails before the highway opens.
Start with a plain-language AI inventory and classification
You do not need to begin with model architectures. You need to begin with use cases. Ask IT to help build a living inventory that classifies AI into two buckets that matter for compliance: internal productivity tools and high-impact decision tools. Internal productivity tools will show up first: copilots, summarizers, drafting assistants, meeting note generators, and code helpers. They feel “low risk” because they do not make final decisions. Yet they are the fastest route to data leakage, confidential information exposure, and unintentional IP transfer.
High-impact decision tools are the ones that can hurt people at scale: hiring screens, performance and compensation analytics, credit-like decisions, pricing optimization, claims adjudication, safety decisions, and any system that influences access to jobs, services, or benefits. These are where bias risk becomes a governance requirement, not a talking point.
This classification step sounds basic, but it is the first bridge into every major framework. The U.S. Department of Justice (DOJ) Evaluation of Corporate Compliance Programs (ECCP) asks whether you have a risk assessment and control design that match how the business actually operates. NIST AI RMF expects you to identify AI risks across contexts and manage them through the lifecycle. ISO/IEC 42001 pushes toward an operational management system. You can nod to all three by doing one thing well: knowing what you are deploying and why.
Treat “human in the loop” as a control, not a slogan
Everyone says “human in the loop.” The compliance move is to define what that means in practice. For productivity tools, the human in the loop should be the person publishing or sending the output. Require a simple rule: AI drafts are not final until a trained employee reviews, edits, and accepts accountability. Add logging so you can verify the review happened. If you cannot demonstrate human review, you do not have human review.
For high-impact decision tools, “human in the loop” must be stronger: the human reviewer needs authority to override, clear criteria for when override is required, and documented reasons. If the tool is used for screening or prioritization, ensure the workflow does not become rubber-stamping. A compliance officer should insist on two design elements: (1) escalation thresholds (when a decision must be reviewed), and (2) audit trails (what the model recommended, what the human decided, and why).
This is where compliance having a seat at the table matters. You can push your ELT away from the fantasy that “we will add governance later.”
Bias: Move from values language to testing and evidence
Bias risk is often discussed as culture. Compliance needs it discussed as proof. For high-impact tools require pre-deployment testing and post-deployment monitoring. That means defining the protected classes and outcome metrics relevant to the use case, documenting results, and setting drift triggers that require re-testing. If IT cannot articulate what “good” looks like and how it is measured over time, you do not have a controlled system.
You need a repeatable process. One that can test, document, decide, and monitor. Compliance can help translate that into governance language that executive leadership understands: controls, evidence, and accountability.
Privacy: Build “do not feed the machine” rules before rollout
Low-to-medium maturity programs tend to discover privacy risk after the first incident. Do not let AI be the reason you learn the hard way. Start with data categories and simple prohibitions: what cannot be entered into third-party AI tools, what can be entered only into approved enterprise instances, and what must never be used for training. Pair this with training that is short, practical, and role-based. If you roll out AI without clear data handling rules, employees will improvise, and improvisation is where breaches live.
Make sure there is an AI incident response escalation pathway. This means when an employee suspects confidential data was entered, when a bot gives harmful advice, or when an output appears discriminatory. If you have an incident response program, connect AI to it now.
IP: Assume you will have confusion and design for it
AI introduces IP risk in two directions. First, employees may paste proprietary content into tools with unclear retention and training terms. Second, employees may unknowingly incorporate third-party content generated by a model into company work product, raising questions about ownership and infringement.
Compliance can drive a simple safeguard: approved tools only, approved terms only, and clear guidance on attribution, verification, and prohibited uses. For developer tools, require that code suggestions are reviewed as if they came from an unknown internet source. Because, functionally, they did.
The bottom line
If AI is coming later this year, your job is not to become a data scientist. A compliance officer’s job is to make sure the company does not confuse speed with strategy. Start with an inventory and classification, operationalize human-in-the-loop, demand evidence for bias controls, set privacy rules before tools roll out, and treat IP risk as a design problem, not a legal cleanup. That is how compliance stays at the table and, more importantly, how it helps the business move fast without losing its footing.
